Further to a number of bulletins issued by the General Contractors Section in 2007 concerning Labourer Negotiations and the subsequent three-week, province-wide ICI strike by the Labourers International Union of North America, we wish to advise members that following (9) days of arbitration spread over several months; Arbitrator, R.O. MacDowell issued his final decision on November 11, 2008.
The award upholds the position of the Construction Labour Relations Association (of which the General Contractors' Section is a constituent), the Industrial Contractors Association and the Waterproofing Contractors Association; finding that the proposed memorandum agreement entered into between the Ontario Masonry Contractors Association and the Labourers was contrary to the Labour Relations Act, and that the Ontario Masonry Contractors Association and the Concrete Floor Contractors Association of Ontario exceeded their authority when they entered into agreements which claimed to be binding upon the CLRAO, ICA, and WCA.
